Terms of Service
These terms govern your use of ElevCert. By creating an account or using the service, you agree to them. Effective 2026-08-06.
1. Acceptance
These Terms of Service form a binding agreement between you (“the user”, “you”) and ElevCert(“we”, “us”). If you do not agree, do not create an account or use the service. We may update these terms from time to time; the version with the most recent “Effective” date on this page supersedes earlier versions, and continued use after an update signals acceptance.
2. Service description
ElevCert is a software tool that helps licensed land surveyors produce U.S. Federal Emergency Management Agency (FEMA) Elevation Certificates and related forms from field measurements. ElevCert formats, organizes, and exports your input; it does not take measurements, perform surveys, sign or seal certificates, or substitute for your professional judgment. You remain solely responsible for the accuracy of any certificate you produce using ElevCert.
3. Account terms
- Accounts are created via our authentication provider. See sign in to access an existing account or create a new one.
- You are responsible for safeguarding your credentials and for all activity under your account. Tell us promptly if you suspect unauthorized access.
- Accounts and credentials are non-transferable; sharing access with people outside your firm is a material breach of these terms.
4. Subscriptions and payment
Paid plans are billed through our payments processor. Pricing, plan limits, and per-certificate fees are listed on the pricing page and updated there. By purchasing a plan or per-certificate export you authorize the applicable charge. Refunds, where applicable, are governed by our refund policy surfaced at checkout.
5. Acceptable use
You agree not to:
- Use ElevCert to produce certificates for properties or jurisdictions in which you are not licensed or otherwise authorized to practice.
- Submit field measurements or other data you know to be falsified or fabricated.
- Reverse engineer, decompile, or otherwise attempt to extract source code, except to the extent applicable law expressly permits it.
- Interfere with the service, including by probing, scraping, or attempting to circumvent rate limits.
- Use the service to violate any applicable law or regulation.
6. Intellectual property
We retain all right, title, and interest in and to ElevCert, including its software, UI, schemas, branding, and documentation. You retain all right, title, and interest in and to the field measurements and other data you submit, and in the certificates you produce. You grant us a limited, non-exclusive license to host, process, and store your submissions solely to operate the service for you.
7. Termination
You may stop using ElevCert at any time and may request deletion of your account and data (see our Privacy Policy). We may suspend or terminate accounts that violate these terms or that pose a security or legal risk. Where feasible, we will give notice before suspension.
8. Disclaimers
ElevCertis provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that certificates produced by ElevCert will be accepted by any particular lender, insurer, building official, or other party; acceptance is governed by their policies and by your professional seal and signature.
9. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or related to these terms or your use of ElevCert will not exceed the greater of (a) the fees you actually paid us in the twelve (12) months preceding the claim and (b) one hundred U.S. dollars (US$100). We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.
10. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
11. Changes to these terms
When we change these terms we will update the “Effective” date at the top of this page. For material changes we will give reasonable advance notice through the service or by email. Continued use after the effective date constitutes acceptance of the updated terms.
